Utah has become the third state to adopt a law exempting guns and ammunition
An increasing number of U.S. states are revolting against the Federal Government's attempts to control the possession of firearms. Individual states are adopting laws exempting guns and ammunition made, sold and used in the state from federal regulations under the Bureau of Alcohol, Tobacco, Firearms and Explosives. According to an article in World Net Daily on March 10, 2010, Utah has become the third state to take this action. This is in addition to the 30 or more states that already have some kind of plans for their own exemptions. Three of the states that have already taken action are Montana, Tennessee and now Utah. It was reported that the Utah law was passed into law with the signature of Gov. Gary Herbert The Firearms Freedom Act was originally introduced in Montana. It declares that any firearms made and retained in-state are beyond the authority of Congress under its constitutional power to regulate commerce among the states. In that state, officials filed suit against U.S. Attorney General Eric Holder and others seeking a court order that the federal government stay out of the management of Montana's firearms within its own borders. The U.S. government responded by demanding dismissal of the actions saying that it can regulate instate commerce under the Constitution's Commerce clause. Meanwhile, the federal government has warned gun dealers in Montana and Tennessee against following the state laws. http://www.examiner.com/x-2547-Watch...t-against-Feds Yep, the federal government has warned federally licensed gun dealers in Montana and Tennessee against following the state laws as the federal license scheme provides the nexus to fed jurisdiction. A common natural person however is not under said federal jurisdiction regulations. |
